California justice dismissed an organization against AIDS claiming increased intervention of public authorities to impose the condom in the middle of the X
bondage toys. The Organization denounced a return in force of the porn not protected.
Anger among activists pro-capote of the AIDS Healthcare Foundation (AHF), the largest world Organization to fight against sexually transmitted diseases. The Court of appeal of California dismissed last week the Organization of its request for tougher controls on the wearing of condoms in the middle of the X in Los Angeles. Reason: the policy for the prevention of sexually transmitted diseases on a filming depends solely city health services, and the "courts can not intervene".
For AHF, which was published in the wake of the verdict accusing release, the decision of the Court of Appeal appears as an admission of failure in the resurgence of IST on porn filming since the beginning of the 2000s. After a short wave of prevention (caused by a number of cases of contamination very media) the X industry is declining protection according to AHF, which calls the health services to mobilize quickly.
Prevention and repression
It is in 2009 that the Organization, "after having exhausted all other methods", decided to conduct the case to justice. A porn actress had just be detected positive to HIV in the San Fernando Valley, the nerve of the X industry, planted point next to Hollywood studios. The case of too much for AHF, claiming justice California to require health services of the County of Los Angeles to take strict measures to impose the use of the condom on the filming of porn films.
"The County of Los Angeles has the duty to protect public health, one of the major responsibilities of a local government, indicates the SCA." "He cannot simply ignore this charge and let thousands of people contract a STD indifference."
In addition to a new effort of prevention, the organization also wanted greater involvement of the authorities of public health: a compulsory and common screening and an automatic closing of the plateaus that flout the
extreme bondage terms of security of the players. Unsuccessful at first instance, AHF did not had more chance on appeal where the Court has reaffirmed that it could not interact in the County of Los Angeles Public Affairs.
"The Department of health continues to support (...)" "State laws that aim to extend the requirements to the adult film industry, to include the mandatory condom use" nevertheless held to reassure the spokesman of the County, Sarah Kissel.
An alarming situation
The rejection of the Court is all the more worrying for AHF IST cases have known a significant progress in recent years. Since 2004, and the revelation of a case of contamination in the environment of the X, no action has been engaged by the County of Los Angeles to try to stop the health crisis according to AHF. The refusal to comply with production studios (protected porn is sold less well), and the indifference of the public authorities have contributed to "a strong resurgence of IST among the X actors, including many cases of HIV, gonorrhea, syphilis, chlamydia, hepatitis..." says the release.
Citing figures from the Department of public health of the County, published in 2009, the Organization recalls that 21 players in Los Angeles (five women and sixteen men) have contracted HIV between 2004 and 2008, that 2 013 cases of chlamydia have been screened between 2003 and 2007, or 965 porn actors have been affected by gonorrhea. A very heavy balance for the capital of X, and which could worsen without urgent intervention of the health authorities.
"The Department of public health recommends the use of the condom on filming, but he never took measures to ensure that its use and protect actors" denounced the Organization, which adds that she intends to continue his legal battle against public authorities.
"The county officials and porn producers must know that we will not stop our efforts to protect public health and fight
glass dildos against the epidemic of STDs in the film X industry" announced the President of AHF, Michael Weinstein.
